Former judge indicted for aggravated sexual
assault, indecency with a child

DENTON, Texas (AP) -- A former state district judge
has been indicted for aggravated sexual assault and
two counts of indecency with a child.

A Denton County grand jury returned the indictments
against former judge Charles Chandler Davis, 47,
on Thursday.

Assistant District Attorney Lee Ann Breeding said
she could not comment on specifics of the case.

"I can say this was not a stranger-on-stranger case,"
Ms. Breeding said. "It was not a relative. I believe it
was a baby sitter employed in the home."

The case involves a 13-year-old girl who recently
told authorities she was sexually molested in 1994,
the Denton Record Chronicle reported Friday.

Jim Horton, Davis' attorney, said the allegations are
unfounded.

"He didn't do it," Horton said. "We think it's a little
strange that 1994 allegations are just now reported.
We feel he'll be exonerated completely."

The Denton County Sheriff's Department said an
arrest warrant for Davis most likely won't be issued
until Tuesday.

Aggravated sexual assault of a child is a
first-degree felony punishable by five years to life in
prison and a $10,000 fine. Indecency with a child
with sexual contact is a second-degree felony
punishable by two to 20 years in prison and a
$10,000 fine.

Former Texas Gov. Mark White appointed Davis,
who now practices law in Bartonville, in 1986 to the
362nd District Court. Davis served two years before
he was defeated in 1988 by David White.

During the 1988 election, Davis caused a storm of
controversy when he filed for both parties' primaries.
He said at the time that judges should not pander to
partisan politics. The Republican Party Executive
Committee voted to encourage Davis to withdraw
from the Republican ballot.

He refused until the Texas Supreme Court declined
to consider a motion allowing him to run on both
ballots.

Davis moved to Austin, where he practiced law for
several years. From July 1994 to March 1997, he
was under disciplinary suspension by the bar
association for missed deadlines and failing to file
the proper documentation.
